5. Collection, processing and use of personal data

5.1. Personal data

Personal data is information about the factual or personal circumstances of a specific or identifiable natural person. This includes, for example, your name, your telephone number, your address, as well as all inventory data that you provide us with when registering and creating your customer account. Static data that we collect, for example, when you visit our web shop and that cannot be directly associated with your person, does not fall down. For example, these statistics are about which pages of our store are particularly popular or how many users visit certain pages of the MYCLASSICO.COM store.

5.2. Customer Account

We set up a password-protected direct access to their stored inventory data (customer account) for each customer who registers accordingly. Here you can view data about your completed, open and recently sent orders and manage their address data and the newsletter. You agree to treat the personal access data as confidential and not to make it accessible to unauthorized third parties. We cannot accept liability for misused passwords unless we are responsible for the abuse.

Unless you log out, you will automatically be logged in. This feature allows you to use some of our services without having to log in again each time. For security reasons, however, you will be prompted to enter your password again, for example, if you want to change your personal information or if you would like to place an order.

5.3. Collection, processing and use of your personal data

Privacy is important to us. Therefore, we hold ourselves in the collection, processing and use of your personal data strictly to the statutory provisions of the Federal Data Protection Act. We collect, store and process your data for the entire processing of your purchase, including any subsequent warranties, for our services, the technical administration and our own marketing purposes. Your personal data will only be disclosed to third parties or otherwise transmitted, if this is necessary for the purpose of contract execution or billing or if you have previously consented. As part of order processing, for example, the service providers we use here (such as transporters, logisticians, banks) receive the necessary data for order and order processing. Our service providers to fulfill their task may only use the data transmitted in this way. Any other use of the information is not permitted and is not carried out by our service providers.

For your order, we need your correct name, address and payment details. We need your e-mail address so that we can confirm the order and communicate with you. We also use these for your identification (customer login). You will also receive your shipping confirmation via your e-mail address.

Your personal data will be deleted insofar as this does not conflict with statutory retention requirements and if you have asserted a cancellation claim, if the data is no longer required to fulfill the purpose for which it was stored or if its storage is inadmissible for other legal reasons.

5.4. Use of your data for advertising purposes

In addition to processing your data to process your purchase at MYCLASSICO.COM, we also use your information to communicate with you about your orders, specific products or marketing promotions and to recommend products or services that may interest you.

You may object to the use of your personal data for advertising purposes at all times or for individual measures without incurring any costs for the future. A communication in text form (for example e-mail, fax, letter) to the contact details mentioned in section 2 is sufficient.

5.5. Competitions, market and opinion research

For competitions, we use your information for the purpose of winning the prize and promoting our offers. Detailed information may be found in our terms and conditions for the respective competition.

We also use your data for market and opinion research. As a matter of course, we use these exclusively anonymized for statistical purposes and only for MYCLASSICO.COM. Your responses to surveys will not be shared or published to third parties. We do not store the answers from our surveys together with your e-mail address or other personal information.

With MYCLASSICO.COM, you can order chargeable items from our line of merchandise. In this context, we process personal data for fulfilling the contract and, in particular, for processing your order, for delivering the goods, for checking your creditworthiness, for processing payment and possible warranty claims. For this purpose, we process above all your first and last name, your gender, your date of birth, your delivery and billing address and your e-mail address as well as your password and your telephone number.

For the purpose of contract processing or billing, your personal data will only be passed on to third parties or otherwise transmitted if this is necessary for the execution of the contract or settlement or if you have previously consented. As part of the processing of your order, for example, service providers used by us (such as logistics companies) receive the necessary data for order processing.

7. Newsletter

For sending the newsletter, we use the so-called double opt-in procedure, which means that we will only send you a newsletter by e-mail if you have previously explicitly confirmed to us that we should activate the newsletter service. We will then send you a notification e-mail asking you to confirm that you wish to receive our newsletter by clicking on a link in this e-mail.

Should you anytime later no longer want to receive newsletters from us, you can revoke them at any time and without additional costs with effect for the future by clicking on the "unsubscribe newsletter" link in the newsletter and then following the instructions. Alternatively, you can unsubscribe from the newsletter by sending a text message (such as e-mail, fax, letter) to the contact details listed in section 2.

8. Cookies

We use cookies on our pages in order to make the visit to our website attractive and to enable the use of certain functions.

Cookies are small files that are stored on your data carrier and that store certain settings and data for exchange with our system via your browser. One differentiates between two different types of cookies, so-called session cookies, which are deleted as soon as you close your browser and temporary cookies that are stored on your disk for a longer period. This storage helps us to tailor our web pages and our offers to you and makes it easier for you to use them, for example by saving certain input from you so that you do not have to constantly repeat it.

Most of the cookies we use are automatically deleted from your hard drive after the end of the browser session (end of the session) (hence session cookies). Through this we can, for example, offer the multi-page shopping cart view, where you can see how many items are currently in your shopping cart and how high your current shopping value is. In addition, we also use the cookies that remain on the hard drive with you. On another visit, it is automatically recognized that you were already with what inputs and settings you prefer and use. For example, these files may allow you to see information that is specifically tailored to your interests on the page. These cookies are automatically deleted after one year.

Our cookies collect for this u.a. following information: session ID, hash for shopping cart, hash for wish list, origin of the user, gender of the visited category, and last viewed pages at MYCLASSICO.COM.

The cookies used by MYCLASSICO.COM do not store any personal data. The cookies we use are therefore not assigned to a specific person and therefore not to you. When the cookie is activated, it will be assigned an identification number. An assignment of your personal data to this identification number is not possible at any time and will not be carried out. Your name, IP address or similar data that would allow the cookie to be associated with you will never be used. Based on the cookie technology, we only receive pseudonymous information, for example, which pages of our shop were visited, which products were viewed, etc.

Accepting cookies is not a requirement for visiting our websites. However, we point out that the use of the shopping cart function and the ordering of products are only possible if you allow us to set cookies.

Of course, you can set up your browser so that it does not store our cookies on the hard disk. The Help menu on the menu bar of most web browsers tells you how to prevent your browser from accepting new cookies, how to let your browser know when you receive a new cookie, or how to delete all cookies you have already received and for all others can lock.

This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about the use of this website is usually transmitted to a Google server in the USA and stored there. However, in the event of activation of IP anonymisation on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases, will the full IP address be sent to a Google server in the US and shortened there.

On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address provided by Google Analytics as part of Google Analytics will not be merged with other Google data. You can prevent the storage of cookies by a corresponding setting of your browser software; however, please note that if you do this, you may not be able to use all the features of this website to the fullest extent possible.

We also use Google Conversion Tracking, an analytics service provided by Google, as an AdWords customer. Google AdWords sets a cookie on your computer ("conversion cookie") if you have reached our website via a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. If you visit certain pages of us and the cookie has not expired, Google and we may recognize that someone clicked on the ad and was redirected to our site. Each advertiser receives a different cookie. Cookies cannot be tracked through the websites of advertisers. The information gathered using the conversion cookie is used to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. Advertisers will see the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, they do not receive information that personally identifies users. If you do not want to participate in the tracking process, you can also opt out of setting a cookie. Please follow the instructions described in section 8 above.

9.2. Microsoft

Our online services also use conversion tracking from Microsoft Corporation (One Microsoft Way, Redmond, WA 98052-6399, USA) ("Microsoft"). We only hear the total number of users who clicked on a Bing ad and were then redirected to the conversion page. No personal information about the identity of the user is given. If you do not want to participate in the tracking process, you can also opt out of setting a cookie. Please follow the instructions described above under section 8.

9.3. Retargeting

This website uses retargeting technologies operated by other providers. Through retargeting, websites of our partners can specifically target advertisers who are already interested in our shop and our products. The insertion of the advertising material takes place during retargeting based on a cookie-based analysis of the previous user behavior. Of course, also, in this case, no personal data are stored and the use of retargeting technology takes place in compliance with the applicable legal data protection provisions. If you do not agree with the delivery of this form of advertising, you can deactivate cookies and / or delete existing cookies via the settings of your Internet browser. Please follow the instructions described in section 8 above.

9.4. Other internet technologies

On this website, information about the surfing behavior of website visitors is collected and stored in anonymous form within the framework of other Internet technologies. This data is stored on your computer using so-called cookie text files and allows us to anonymously analyze surfing behavior. For example, from which city a website visitor comes, which browser type and which operating system the website visitor uses and which pages he has visited on the website. In no case can the obtained data be used to personally identify the visitor to this website. The collected data will only be used to improve the offer. Therefore, all IP addresses are truncated so that IP addresses are only processed in anonymous form. There is no other use or disclosure to third parties.

9.5. Right to Object

In general, you can object to the collection, processing and use of data by the analysis services and retargeting technologies used on this website with effect for the future. This will save an opt-out cookie on your device. This opposition is valid as long as you do not delete the cookie.

This would be the case, for example, in the case of data processing for humanitarian or natural disasters or other man-made disasters, in which case the processing would then be based on Article 6 (1) (d) GDPR (recital 46 to the GDPR).

Additionally, processing operations on the legal basis could be based on Article 6 (1) (f) GDPR. This is based on processing operations that are not covered by any of the above legal bases if processing is necessary to safeguard the legitimate interests of our company or a third party, unless the interests, fundamental rights and freedoms of the person concerned prevail. Such processing operations are particularly permitted to us because they have been specifically mentioned by the European legislator, as a simple but understandable legitimate interest, for example, the prevention of fraud by a customer of the person responsible to mention (recital 47 to the GDPR).

16. Final information

We disabuse that the provision of personal data is partly required by law (for example, under commercial or fiscal regulations) or may arise from contractual arrangements and requirements (such as details of the contractor for the benefit of the person). Occasionally it may be necessary for a contract to be concluded that a data subject provides us with personal data that must then be processed by us. For example, the data subject is required to provide us with personal information if our company enters into a sales agreement with her. Without this personal data, the contract with the data subject could not be concluded effectively or we are not prepared to conclude such a contract. Prior to any personal data being provided by the data subject, the latter may contact our company to ascertain whether the provision of the personal data is required by law or contract or to conclude a contract, whether there is an obligation to provide the personal data, and which consequences of the non-provision of personal data could have. Our employees on a case-by-case basis on request can provide information on this.
